By accessing and using the services provided by Atomic Systems ("we," "us," or "our"), you agree to these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Atomic Systems.

2. Services

We provide software development, web development, application development, and related technology services. All services are provided "as is" and "as available" without any warranties, either express or implied.

3. Client Obligations

As a client, you agree to:

Provide accurate and complete information
Maintain the confidentiality of any access credentials
Use our services only for lawful purposes
Pay all fees as agreed upon in project contracts
Provide necessary materials and feedback in a timely manner

4. Project Delivery

Project timelines are estimates and may be affected by various factors
Final deliverables are subject to the agreed-upon project scope
Additional features or changes may require separate agreements
We maintain ownership rights until final payment is received

5. Intellectual Property

You retain ownership of your original content
We retain ownership of pre-existing materials and development tools
Upon full payment, you receive a license to use the developed solutions

6. Limitation of Liability

Atomic Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

7. Termination

We reserve the right to terminate services for:

Non-payment
Violation of these terms
Fraudulent activities
Illegal use of services

8. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services constitutes acceptance of modified terms.

9. Governing Law

These terms are governed by the laws of Texas US, without regard to its conflict of law principles.

Atomic Systems Simply Provide You With Systems That Works!

Atomic Systems and M Waseem Zaheer are in no way responsible for the success of your business or the performance of your technology solutions beyond our agreed-upon specifications. As a technology development agency, our responsibilities are limited to producing the software, applications, websites, and digital solutions outlined in the project scope, within the scheduled timeframe. The performance and success of your technology solutions are contingent upon numerous factors outside of our control (including but not limited to: user adoption, your implementation strategy, your infrastructure and hosting choices, the maintenance and updates you perform, your business operations, market conditions, etc.). It is your responsibility to have a qualified legal representative review all materials and code created by Atomic Systems to ensure compliance with standards in your industry. We offer no guarantees other than our commitment to develop technology solutions according to the agreed-upon specifications and industry best practices. We create and deliver the contracted technological assets and provide the agreed-upon support services, but we do not guarantee specific business outcomes, market success, or user adoption rates. We do not participate in revenue-sharing partnerships. We do not offer any guarantees of profitability. This is a complex technical space, and the business risk is yours to bear as the business owner. We do not offer refunds for work performed.
